GENERAL CONDITIONS OF SALE OF THE DOMAINE ET CHÂTEAU DU MAUNY
The accommodation (gîtes and guest rooms) is under the control of SAS DOMAINE ET CHÂTEAU DU MAUNY Siret 88884928800012, RCS of Châlon sur Saône.Accommodation service in Gîtes and Chambres d'hôtes with reception by the owners. In the rental rates, cleaning, bed linen and towels are included. Breakfast is included in the price of the guest rooms. Optional paid services can be booked either when booking the accommodation or on site with the owners. These services are subject to availability.The Anny and Esope gîtes are labelled 4* meublés de tourisme by Atout France in 2021.
Article 1 - Duration of the stay : The signatory of the contract concluded for a fixed period will not be able under any circumstances to take advantage of any right to remain in the premises at the end of the stay.
Article 2 - conclusion of the contract : The reservation becomes effective as soon as the tenant has paid the owner (by credit card or bank transfer) a deposit of 50% of the total amount of the rental for a gite. For guest rooms, the credit card is taken as a deposit, there is no deposit to pay except for promotions such as early booking (50% of the total amount) or "3 nights or more" (100% of the amount).For the gîtes, one copy of the signed rental contract must be returned before the arrival date. A second copy is to be kept by the tenant.The rental agreement concluded between the parties may under no circumstances be used, even partially, by third parties, whether natural or legal persons, except with the written agreement of the owner.Any infringement of this last paragraph could lead to the immediate termination of the rental agreement to the detriment of the Tenant, the proceeds of the rental agreement remaining definitively with the owner.
Article 3 - absence of withdrawal: For reservations made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, and this in accordance with Article L121-21-8 of the Consumer Code relating in particular to the provision of accommodation services provided at a date or according to a specific period.
Article 4 - Cancellation by the Tenant : Any cancellation must be notified by e-mail or registered letter to the owner.                a) Cancellation before the arrival in the premises:                        - For the guest rooms, the cancellation can take place up to 48 hours before your arrival. After that, the totality of the stay is due.                        - for the gîtes, the deposit is acquired at the time of booking. A cancellation insurance is automatically taken out by the client without any additional cost. In case of cancellation within the framework of the insurance, Trustyway Voyage will refund the client. In case of cancellation less than 15 days before the stay without insurance, the balance of the stay is due by the client and will be deducted from the credit card.                        - If the tenant does not show up within 24 hours after the arrival date indicated on the contract, the present contract becomes null and void and the owner can dispose of his gîte. The total amount of the stay will be retained by the owner.                        - If the cancellation is linked to anti-COVID measures (confinement or movement restrictions only), the sum may be deferred to the amount of a future stay (except July-August).
                b) If the stay is shortened, the rental price remains with the owner. No refund will be made.
Article 5 - Cancellation by the owner: The owner will pay the tenant the totality of the sums paid, as well as an indemnity of 50% of that which the tenant would have supported if the cancellation had occurred of his fact at this date.
Article 6 - Arrival and departure : The tenant must arrive on the day of the beginning of the stay between 5 and 8 pm. In case of late or delayed arrival, the tenant must inform the owner. The departure is before 10am in the gîte, 11am in the room on the last day.
 Article 7 - Payment of the balance: The balance of the rent is paid at the end of the stay by credit card, cash or ANCV holiday vouchers (not more than 50% of the total amount for ANCV) for the guest rooms. It is deducted from the credit card 15 days before your arrival for the rentals in gîte. Cheques are not accepted. The tourist tax is in addition to the price of the rental, it is 0,45€/day and per adult for the guest rooms, and 0,80€/day and per adult for the gites.
Article 8 - Inventory of the accommodation: An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure of the gite. This inventory is the only reference in case of dispute concerning the state of the premises. The state of cleanliness of the gîte on the tenant's arrival must be noted in the inventory of fixtures. Cleaning is included in the price of the rental but the tenant must take out his household and waste bins in the bins provided in the car park and must put away his clean dishes in the cupboards. Part of the deposit may be retained if the accommodation is returned in an abnormally dirty state.
Article 9 - Security deposit : On the arrival of the tenant, a security deposit of 500€ will be blocked on the tenant's bank card. After the inventory of fixtures at the end of the rental period, this deposit will be released, after deduction of the cost of repairing the premises if any damage is found.
Article 10 - Use of the premises: The Tenant must ensure the peaceful nature of the rental and use it in accordance with the purpose of the premises. Noisy and excessively alcoholic parties are forbidden.
Article 11 - capacity: The contract is established for a maximum capacity of persons. If the number of tenants exceeds the capacity, the owner may refuse the additional persons. If the capacity is higher, a supplement may be charged for the extra person(s). Any modification or breach of contract will be considered at the client's initiative and the total amount of the rental will be retained by the owner.
Article 12 - Pets : A pet is allowed in the gîte and in 1 guest room only, only after acceptance by the owner. A supplement of 15€ per day will be charged in addition to the rent. The owner is free to refuse access to the accommodation if a person arrives with a pet without prior notice and/or without the prior agreement of the owner. The amount of the rental fee is considered to have been paid to the owner. Animals must not be left alone without supervision in the accommodation. Outside, they must be kept on a leash. Inside, dogs must be kept in the dining room and the entrance, and access to the bedrooms and sofas is forbidden. Please respect the cleanliness and quietness of the place (pick up after your dog, do not bark in an untimely manner). Unwanted behaviour may result in the premature termination of the rental and compensation may be charged if damage has occurred.
Article 13 - Insurance: The hirer is responsible for all damage caused by him. He must be insured by a holiday insurance contract for these different risks. The owner is insured by MMA (71 Autun) for liability and for the buildings.
Article 14- Litigation: Any complaint must be discussed immediately with the owner in order to find an amicable solution.
